Dans une période où les libertés économiques de circulation (droit économique, libre-échange, commerce international et libertés européennes de circulation) sont de plus en plus contestées, il importe de livrer une réflexion approfondie sur la capacité des disciplines (droit, sciences humaines et sociales, sciences dures) à questionner le sens de ces libertés. Différents savoirs interrogent ainsi la conception que leurs constructions et analyses portent sur ces libertés. Quelles sont les directions prises ? Quelles sont les finalités poursuivies ? Faut-il constater des points de rupture entre les ambitions initiales et les réalisations observables aujourd’hui ? Associant chercheurs confirmés et jeunes chercheurs dans un dialogue intergénérationnel, cet ouvrage revêt de manière originale un caractère pluridisciplinaire, international et comparé. Il place les dynamiques contemporaines du droit économique et des phénomènes de circulation dans une perspective permettant leur compréhension à travers des études organisées autour d’enjeux clairement identifiés. = At a time in which economic freedoms of movement (economic law, free trade, international trade and European freedoms of movement) are increasingly being challenged, it is crucial to explore in depth the capacity of disciplines (law, human and social sciences, hard sciences) to question the sense of these freedoms. Data verzamelen is big business. Het issue vandaag en morgen is hoe om te gaan met alle verzamelde gegevens zonder privacyregelgeving met voeten te treden. Net nu zijn de regels waaraan bedrijven, organisaties en overheden zich moeten houden, ingrijpend gewijzigd door de nieuwe Algemene Verordening Gegevensbescherming die op 24 mei 2016 in werking is getreden. Opvallend is dat deze verordening rechtstreeks toepasselijk is en moet niet meer omgezet worden in nationale wetgeving! 0Wat is in deze verordening opgenomen? Als eerste Belgische uitgeverij lanceert Politeia de Codex Algemene Verordening Gegevensbescherming. De 3-talige publicatie (NL ? FR ? EN) bevat de definitieve versie van de Verordening in 99 artikelen die worden toegelicht door 173 overwegingen. Deze gebruiksvriendelijke codex met inhoudelijke meerwaarde wordt in het voorwoord door Willem Debeuckelaere, voorzitter van de Privacycommissie, omschreven als ?ons kompas maar ook ons evangelie? om in België met de verordening aan de slag te gaan.

Le Parlement européen a entériné le 14 avril 2016 une importante réforme des règles de protection des données à caractère personnel. Les principaux axes de cet ambitieux chantier législatif sont une harmonisation plus poussée au sein de l’Union, et une réponse aux multiples évolutions sociétales survenues depuis l’adoption de la directive européenne 95/46. Les règles nouvelles entreront en vigueur en 2018, mais toutes les organisations et entreprises doivent dès à présent se préparer à de nombreux changements. Ceux-ci concernent notamment les « notices vie privée » et l’information des consommateurs, mais la réforme n’est nullement confinée à ce seul domaine. Au contraire, le législateur de l’Union a consacré des obligations nouvelles très concrètes pour la plupart des entreprises et des organisations : tenir un registre interne des traitements, désigner un « délégué à la protection des données », conduire des études d’impact préalables, renforcer les mesures de sécurité, etc. Les entreprises et organisations doivent aussi anticiper une transformation profonde de leurs relations avec le régulateur. En effet, celui-ci sera désormais doté de pouvoirs de sanction et d’enquête très étendus. C’est pourquoi il a paru utile de présenter les principaux aspects du nouveau régime, dans une approche résolument pragmatique, en donnant la parole à des praticiens du secteur
